Terms of Service

1. Purpose

These terms of service (the "Terms") govern access to and use of the darkom.tn website and the DARKOM mobile application (together, the "Service"), published by DARKOM, a company being incorporated (SARL or SUARL) under Tunisian law ("DARKOM", "we").

DARKOM is a matchmaking platform: it lets individuals and professionals publish property listings (sale and rental), lets craftsmen and home-service providers present their business, and lets visitors browse and contact them. DARKOM is neither a real-estate agent, nor an agent of any party, nor a party to the contracts concluded between users.

By creating an account or using the Service, you accept these Terms and our privacy policy. If you do not accept them, do not use the Service.

2. Definitions

• User: anyone who accesses the Service, with or without an account.
• Advertiser: a user who publishes a property listing.
• Craftsman or Pro: a user who creates a professional profile to offer services (plumbing, electricity, painting, carpentry, air conditioning, cleaning, moving, etc.).
• Content: anything published by a user on the Service: listings, texts, photos, prices, profiles, reviews, messages.
• Verified listing: a listing that has passed the DARKOM team check described in section 5 and carries the "DARKOM verified" badge.

3. Access to the Service and accounts

Browsing listings and profiles is free and open. Publishing a listing, creating a craftsman profile, sending messages, favourites and reviews require an account.

• You must be at least 18 years old and have the legal capacity to contract.
• Accounts are created by email or Google. Authentication is operated by our provider Supabase.
• You undertake to provide accurate information and keep it up to date. An account is strictly personal: you are responsible for any activity carried out from your account and for keeping your credentials confidential.
• One natural or legal person per account. Creating multiple accounts to circumvent a suspension is prohibited.

4. Property listings

By publishing a listing, the Advertiser warrants that:

• the property really exists, at the address and with the characteristics stated (surface, rooms, floor, price);
• they own the property or hold a mandate or written authorisation from the owner to offer it;
• the photos show the property offered, were taken by them or with the author's permission, and contain no third-party data (number plates, faces, documents);
• the displayed price is the price actually requested, in Tunisian dinars, excluding undisclosed agency fees or charges;
• the listing contains no discriminatory, misleading, unlawful or irrelevant content.

Publishing several listings for the same property, inserting contact details or links in the title, description or photos, or using the Service to offer properties whose sale is prohibited, is forbidden.

The Advertiser undertakes to withdraw or mark as sold or rented any listing whose property is no longer available. DARKOM may remove without notice any inactive, duplicate or non-compliant listing.

Publishing listings is free for individuals. Paid options (featured placement) may be offered; their conditions are stated at the time of ordering.

5. Verification and moderation

Every listing and every craftsman profile is reviewed by the DARKOM team before publication (status "pending"), then published with the "DARKOM verified" badge or rejected with a reason. We undertake to process publication requests and reports within 48 business hours.

Verification is a consistency check (photos, price, location, account identity, documents provided by craftsmen). It is neither an appraisal nor a guarantee of the condition of the property, the quality of services or the solvency of the parties. Each user must visit the property, check the documents (title deed, contract, quote) and never pay a deposit without a written contract.

DARKOM may at any time, without notice, refuse, edit, unpublish or delete Content that does not comply with these Terms or the law.

6. Craftsmen and professional profiles

By creating a Pro profile, the Craftsman warrants that they actually carry out the declared activity, hold the necessary permits and qualifications, and operate in the governorates indicated. The contact details (phone, WhatsApp) displayed on the profile are intended to be used by potential customers through the Service.

The Craftsman is solely responsible for their quotes, services, prices, invoicing and tax and social obligations. DARKOM takes no commission on services and plays no part in their performance.

7. Reviews, messages and user content

Users may leave a review about a Craftsman, send private messages to Advertisers and Craftsmen, and save favourites. By publishing Content, you undertake that it is:

• honest and based on a real experience (for reviews);
• respectful: no insults, harassment, threats, hateful or discriminatory remarks;
• lawful: no sexual, violent or fraudulent content, no invasion of privacy or infringement of third-party rights;
• free of unsolicited canvassing, spam, advertising for third-party services or attempted scams.

Reporting and blocking. Every listing, profile, review and conversation has a "Report" button. You can also block a user: they will no longer be able to message you. Reports are reviewed within 48 hours.

Sanctions. In the event of a breach, DARKOM may delete the Content, issue a warning, temporarily suspend the account or terminate it permanently, depending on the seriousness and repetition of the facts. Fraudulent behaviour may be reported to the competent authorities.

8. Launch offer

During the launch offer, the Service is free for Advertisers and Craftsmen, with no limit on the number of listings. Listings published during this period stay online for 6 months from their publication date, unless removed or deleted in accordance with these Terms. The first Craftsmen to sign up may receive the "Founder" badge.

This free access is temporary and has no announced end date. DARKOM may end it or introduce paid features; in that case, the Advertisers and Craftsmen concerned are informed by e-mail or notification at least 30 days before any paid feature applies, and no paid feature applies before that notice period has elapsed. The terms of the following section then apply to paid features.

9. Subscriptions and payment

Craftsmen may subscribe to a plan (free Starter, Pro, Premium) giving access to additional features described on the Plans page. Prices are shown in Tunisian dinars, all taxes included.

• Payment is made by bank card or e-wallet through our provider Konnect (Flouci). DARKOM stores no card data.
• The subscription takes effect on receipt of the payment confirmation, for the chosen period (monthly or yearly). It is not renewed automatically without your action or explicit consent.
• Any period started is due. If the Service malfunctions due to DARKOM and is not fixed within 7 days, a pro-rata refund may be granted on request to darkomtunisie@gmail.com.
• An invoice is available on request.

10. Role and liability of DARKOM

DARKOM provides a technical tool for publishing and matchmaking. DARKOM is not a party to the transactions, visits, contracts, quotes or payments concluded between users, and guarantees neither the completion of a transaction nor the quality, safety or legality of the properties and services offered.

We use reasonable means to ensure the availability and security of the Service, without guaranteeing the absence of interruptions or errors. The Service may be suspended for maintenance. To the extent permitted by law, DARKOM's liability is limited to direct damages and, for paid services, to the amount paid during the last 12 months.

11. Intellectual property

The Service, its brand, logo, design, code and databases belong to DARKOM or its partners and are protected by intellectual property law. Any substantial extraction, reproduction or reuse of listings and profiles (scraping) without written permission is prohibited.

You remain the owner of the Content you publish. You grant DARKOM a free, non-exclusive, worldwide licence to host, reproduce, adapt (cropping, compression, translation) and distribute it on the Service and its promotional channels, for the duration of publication and for legal archiving purposes.

12. Suspension, termination and account deletion

You may delete your account at any time from your profile ("Delete my account" section) or by request to darkomtunisie@gmail.com. Deletion removes your listings, your Pro profile and your favourites; reviews and messages already sent to other users may be kept in anonymised form. Retention conditions are detailed in the privacy policy.

DARKOM may suspend or terminate an account in the event of a breach of these Terms, fraud, prolonged inactivity (24 months) or a legal obligation. A suspended account can no longer publish, contact or be contacted; its public content is unpublished.

13. Personal data

The processing of your personal data is described in our privacy policy, which forms an integral part of these Terms.

14. Changes to the Terms

DARKOM may amend these Terms to adapt them to the Service or to regulations. The update date appears at the top of the page. In the event of a substantial change, users with an account are informed by email or notification at least 15 days before it takes effect. Continued use of the Service after that date constitutes acceptance.

15. Governing law and disputes

These Terms are governed by Tunisian law. In the event of a dispute, the parties will seek an amicable solution; failing that, the competent courts of Tunis will have exclusive jurisdiction, subject to mandatory consumer-protection rules.
